Any employee or applicant that believes that his or her employment rights have been violated on the basis of disability has the right to file a charge of discrimination with the Equal Employment Opportunity Commission (EEOC.) The employer will be notified that a charge has been filed. There are a number of ways a charge may be handled including mediation.
